The Supreme Court gave a big decision while hearing a petition seeking the inclusion of female candidates in the National Defense Academy (NDA) examination. During this, the court also reprimanded the army. Keeping its side in the court, the army said that this is a policy decision. However, the court termed the army's decision as based on "gender discrimination".

After this, while giving an interim order in the matter, the court has also allowed female candidates to appear in the NDA exam to be held on September 5. At the same time, the admission will be after the final decision of the court.

The petitioner called it a violation of fundamental rights

The petition allowing women to appear for the examination said that eligible female candidates having 10+2 level of education are not allowed to appear in the NDA/NA examination on the basis of gender. At the same time, male candidates get an opportunity to appear in the same level of examination and get qualified to be trained to be appointed as Permanent Commissioned Officers in the Indian Armed Forces. This is a clear violation of the fundamental right to equality of opportunity in matters of public employment and protection from discrimination on the basis of gender.

The court directed the army to prepare the structure

Reprimanding the army, the Supreme Court said that you are forcing the judiciary to give orders. So it would be better if the army creates a framework for this rather than invoke court orders. We are allowing those girls who have approached the court to appear in the examination.

A bench of Justices Sanjay Kishan Kaul and Hrishikesh Roy slammed the Indian Army for "persistent gender discrimination" against women candidates and also noted that the Indian Navy and Air Force have already made provisions, but the Indian Army is still lagging behind. .
